Berkeley enacts balcony safety requirements

BERKELEY -- Starting July, several thousand properties are now subject to periodic inspections of decks and other exposed structures under new rules crafted in response to the June 16 collapse of a fifth-floor balcony at a downtown apartment complex that killed six young adults and injured seven more.
The City Council on Tuesday approved urgency ordinances that require property owners to hire a licensed expert to inspect and certify the structural integrity of decks, balconies, staircases, landings and other weather-exposed areas within six months, and thereafter every three years. The ordinances apply to any residential building with more than three units.
Industry representatives warned that acting prematurely and hastily and without input from experts could have unanticipated and adverse outcomes. But a sense of urgency that the city must take firm action in response to the disaster and do something to protect the public against the possibility of similar ones occurring prevailed throughout the night's often-passionate debate.


The mandated inspections would be performed by a licensed general contractor, structural pest control specialist, architect or engineer. Several residents questioned how the city staff would be able to oversee the program given its current resources.
Councilman Laurie Capitelli suggested enlisting the help of the American Society of Home Inspectors, noting that it had done private inspections of 14 balconies in the city's Elmwood section since the accident and had recommended two of those balconies for closure.
NEW RULES New inspection rules:
Existing decks, balconies, landings and other weather-exposed areas must be inspected and certified by a licensed expert within six months, and thereafter every three years
New building standards:
  • set standards for ventilation of weather-exposed structures such as balconies, landings, decks and stairs.
  • require balconies, landings, decks and stairs to be constructed of naturally durable or preservative-treated wood, corrosion-resistant steel or similar approved materials.
  • require wood members that support the floors be separated from them by an impervious moisture barrier.
  • apply to any residential building with more than three units.

The Home Inspector is on Your Side When Buying or Selling

When you are buying, or selling a home, the home inspector is on your side.

Home inspectors are there to let you know what the condition of the property, not to sell you repairs (it is against the law to offer to do repairs), not to make the sale (we get paid, whether you buy the house or not),  and not to make your real estate agent happy (they are not our clients)

In fact, in most situations, we are the only person involved that does not have a financial bias.

To find a properly certified and ethical inspector call me, or visit ashi.org to find and inspector in your area. Be sure to pick your own inspector. Your realtor may like a specific inspector, for reasons that are not in  your best interest.

Has Someone Died in the House You Want to Buy?

On July 21, 2014, the Pennsylvania Supreme Court held their decision that a death in a home, to include murders/suicides, does not constitute a material defect that has to be disclosed to a buyer. The truth is, there are people who care to know, but in most states the laws do not require sellers and agents to disclose it, including California. But beware, there is the law, and then there is what people actually decide to disclose.

Most people do not even think about the subject when buying a home because they are assuming that it is a law to disclose that information and that the Realtor would tell them. Would you want to be made aware, so that you can make the best decision for yourself?

Chimney and Fireplace Home Inspections

Time for critical chimney and fireplace home inspections
We educate home inspectors and home owners all year long about the necessity of chimney and fireplace inspections, and National Chimney Safety Week increases awareness as we head into the upcoming seasonal concerns.

CSIA’s National Chimney Safety week – September 28 to October 4 – will reach the public via media interviews and features, as well social media that includes videos about maintaining chimneys and fireplaces. 

Despite the ongoing news about fires through fireplace or chimney problems, many home owners do not fully understand the importance of an inspection. If they don’t use their fireplaces, “why do I need an annual inspection?” Or, if they don’t have a fireplace, but their chimney appears O.K. and there’s no odor or issues that would suggest a problem, why does it need an inspection?

From 2009 to 2011, there was an average of 24,300 chimney fires in the U.S. resulting in $30.8 million in damage. And, according to the most recent 2010 census, 2.44 million homes used wood as their main house heating fuel.

Unfortunately, whether it’s a wood-burning fireplace collecting creosote that leads to a fire, a fireplace that can ignite even if you don’t use it on a regular basis, or a chimney that lacks proper venting or a lining that can result in carbon monoxide threats.

A Cheap Home Inspection? Really? Buyer Beware

When it comes to choosing a home inspector you don't want "cheap"--you want "good." 

A good home inspector can save you more money than the extra he/she might cost compared to someone who just breezes through the place. If you're considering a house purchase, it's in your best interest to learn as much as possible about the house, and I don't think you'll get that from "cheap."


Look for someone with lots of experience working in your area.  In California the inspector should be certified by CREIA or ASHI; better if certified by both. 


Also review them on the BBB site; do not rely Home Advisor list, or your real estate agent. 


And don't be fooled by other so called certifications other than CREIA or ASHI. Go to CREIA.org or ASHI.org to verify certifications; there are NO other valid certification groups.

What Should Be in Your Home Inspection Report?

The California Real Estate Inspection Association (CREIA) wants homebuyers and home sellers to know that a quality, professional inspector will make known their findings in a written report.
A written inspection report is at the center of every home inspection, and is required by the California Business and Professions Code, and the CREIA Standards of Practice. Although an inspector may provide insight into his or her report language with verbal onsite comments or follow-up explanations, one should rely on the language and finding of the written inspection report.
For a professional home inspector, the written report is the formal, final, and factual declaration of what was discovered about the property on the day of the inspection. This is the standard centerpiece of the home inspection profession. What is written overshadows what anyone might claim to have said. This also includes oral comments by others who challenge a professional inspector’s report but refuse themselves to put it in writing.
There are several variations of professional inspection reports used in California such as field- generated checklist style of report (with follow-up typed compilation or action list); reference book (tear sheet checklists corresponding to items in a reference book); checklist style; written narrative report or other hybrids versions. Many inspectors also use digital photographs to illustrate their findings.
In addition to the written report produced by a professional inspector, sellers and real estate agents also have an obligation to complete a detailed disclosure statement, which lists known conditions that can affect the habitability, desirability, safety or value of the property. Real Estate disclosure has been required in California since the mid-‘80’s Easton case. It’s critical for consumers to carefully examine all of these documents while making final purchase decisions on what is most likely the largest investment they will ever make.
Make sure you retain the services of a professional home inspector. Since 1976, CREIA, a non-profit voluntary membership organization has been providing education, training, and support services to the real estate inspection industry and to the public. Inspectors must adhere to CREIA's Code of Ethics and follow the Standards of Practice developed by the association. These Standards of Practice have been recognized by the State of California, and are considered the source for Home Inspector Standard of Care by the real estate and legal communities.

Negative response to home and mold inspection findings.

My clients often get negative or unusual responses from some of my home and mold inspection findings. As a nationally certified and recognized home and mold expert, let me say I do make mistakes. But, like most inspectors, I call em as I see em.

My findings are my professional findings, and I put them in writing. If you get push back from others about your inspector findings:  home owners, realtors, other contractors, be sure to get their responses in writing.

Remember, that your inspector should be their only for you. We cannot have multiple clients, nor can we do any repairs.

Don't be bullied into thinking our findings are inaccurate, from others who have an emotional or financial interest in the sale of the property. Some new inspectors might be influenced by a bully, so be vigilant with such a professional.

Your inspector is their to protect your safety and interest in the property, so you know what you are getting.

Be carful out there.

In competitive markets like  it’s not rare to just forego a home inspection or say you won’t ask for any repairs. People that are doing that and purchasing properties that they could possibly have to dump tens of thousands of dollars into later.
This is the kind of mistake that Trulia real estate expert Michael Corbett says is a “disaster waiting to happen.”
“I would never waive an inspection,” he says. “I would pass on the house before I’d waive on an inspection, mainly because I may get to a house and realize [too late] that there are issues.”

25% of homeowners wouldn't buy their home again.

 One out of four homeowners admit they wouldn’t buy their home again if they had the chance, according to a recent survey by real estate brokerage Redfin.

Half of homeowners admitted to having regrets about their home purchase in a similar study by Trulia released last August. The majority of people with buyer’s remorse said they regretted choosing a home that wasn’t large enough for them.

“In competitive markets like D.C., it’s not rare to just forego a home inspection or say you won’t ask for any repairs,” he says. “People are doing that and purchasing properties they could possibly have to dump tens of thousands of dollars into later.”
This is the kind of mistake that Trulia real estate expert Michael Corbett says is a “disaster waiting to happen.”
“I would never waive an inspection,” he says. “I would pass on the house before I’d waive on an inspection, mainly because I may get to a house and realize [too late] that there are issues.”
The biggest factor contributing to homebuyers’ remorse appeared to be affordability. Nearly one-third of homeowners who reported a household income of less than $100,000 said they were unhappy with their decision. In contrast, just 14% of homeowners who earned more than $100,000 said they were unhappy, according to the survey.
Younger homeowners were also more likely to have regrets. About 28% of homeowners under 65 said they regretted buying their home, compared to 14% of senior homeowners. And one in five homeowners with kids still living at home said they regretted their home purchase as well.
Redfin’s findings come around the same time as new home sales have begun to lag in the U.S. Sales of single-family homes fell by 14.5% to an eight-month low in March, with just 384,000 units sold. Experts have blamed slow sales on bad weather, low home inventory, rising mortgage rates, and a rise in vacant homes (homes that are under repair or being rented).  Whatever the case, one thing is certain  — buyers today are at a distinct disadvantage when it comes to finding a home that meets every point on their checklist.
“One of the biggest regrets homeowners have is feeling pressured [to buy],” says Marshall Park, a Redfin agent based in Washington, D.C. “There aren’t enough homes on sale now, they’re sort of under the gun to buy their home.
In other cases, owners said they loved their home but were unhappy with their chosen neighborhood. Neighborhood-related complaints made up four of the top 20 homeowner regrets in Trulia’s report. Fourteen percent of homeowners said they wish they’d vetted their neighborhood more, and 15% wished they had picked one closer to work.
“Very often our clients fail to do basic research and end up living in the right house but the wrong town,” says Ali Bernstein of Suburban Jungle Realty Group, which specializes in helping New York City renters transition into suburbia. “Agents are there to sell you the house, but the way the real estate market is set up, they don’t tell you about the towns. You’ve got to find a town that fits your personality.”
So how can you make sure you get through the whole home buying process without disappointment? Here are a few tips.
Don’t bite off more than you can chew. Your housing costs should typically take up less than one-third of your total household budget (or 40% for those who live in high-cost areas like New York or San Francisco) — property taxes and homeowner’s insurance included. Free mortgage calculators are plentiful online and can give you a pretty good estimate of what you can afford in your area.
Think beyond the inspection. In addition to a home inspection, don’t kid yourself into thinking maintenance costs end there. “People forget about the ongoing homeownership costs,” says Corbett.  “Not just the closing costs, but the ongoing homeownership costs and keeping a slush fund for ‘invisible systems’ like electric and plumbing that will eventually break down.”  Keep an emergency savings account flush with at least $1,000 to handle any unexpected maintenance issues.
Hire a good real estate agent. In Redfin’s survey, more than 30% of homeowners said they felt like their real estate agent wasn’t very helpful, and another 8% said their agent was the worst part of the homebuying process. Always vet your real estate agent. Ask trusted friends and family for recommendations and come up with a list of your top picks. It’s wise to arrange to meet in person at their office. Not only will you get a sense of their personality, but you can take a look around their workspace to see how seriously they take their job.
Get to know your neighborhood. With such low inventory out there, buying a home can feel like a dog-eat-dog competition. Take the time to vet your choice of neighborhood before rushing a bid on a home there. That means driving by at several times throughout the day — morning, noon and night — to get a feel for the environment. You might discover a nearby highway makes too much noise at night, or morning school bus traffic that could make your commute a disaster.
